What is Joint Venture?

Joint Venture is a legal doctrine that allows for a person to be charged with a crime in Massachusetts if he aided, assisted or encouraged others in the commission of the crime and shared the intent required to commit the crime. Joint Venture is intended to treat all defendants as equally culpable, even if there was a principal defendant who engaged in the physical commission of the crime.  In this case Alfredo Velez testified that Donovan took Raustein’s wallet after he fell to the ground.  The prosecutor argued that Donovan participated as a “joint-venturer” in the armed robbery of Raustein and by virtue of this doctrine was also responsible for Murder in the First Degree.
